No Agency Relationship Created by Browsing

Browsing this site, submitting an inquiry form, or exchanging messages does not, by itself, create a broker/client or agency relationship. An agency relationship is established only upon execution of a written representation agreement signed by both you and the brokerage.

These terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Venue for any dispute lies in the state or federal courts located in Sonoma County, California.

SMS and Mobile Messaging Terms

  1. Entity Identification & Scope. Fermin Escutia operates an automated mobile messaging service to deliver property listing updates, open house alerts, showing confirmations, and real estate advisory communications.
  2. Cadence & Frequency. Message frequency varies based on user search activity and transaction milestones.
  3. Rates. Standard message and data rates may apply.
  4. Opt-Out & Support Handlers.
  5. Mobile Carrier Liability Waiver. Mobile carriers (including AT&T, T-Mobile®, and Verizon Wireless) are not liable for delayed or undelivered messages.
  6. Subscriber Warranty. You represent that you are the authorized account holder for the mobile number provided and agree to notify Fermin Escutia immediately if your phone number changes.

SMS Terms and Conditions

1. Program description. We use SMS to confirm appointments, send reminders, and notify clients of schedule updates or important changes, as well as to send property listing updates, open house alerts, and showing confirmations you have requested.

2. Opting out. You can cancel the SMS service at any time. Just text STOP. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time, and we will start sending SMS messages to you again.

3. Help. If you are experiencing issues with the messaging program, you can reply with the keyword HELP for more assistance, or you can get help directly at Fermin.Escutia@gmail.com.

4. Carrier liability. Carriers are not liable for delayed or undelivered messages.

5. Rates and frequency. As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency may vary. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
